Idaho ABC Guidance Regarding Curbside Sales of Mixed Alcohol Drinks

In the wake of Idaho Governor Brad Little’s emergency order closing non-essential businesses and limiting restaurants to off-premises operations via curbside or delivery services, it appeared that bars in Idaho would have to close completely given that current Idaho law prohibits the off-premises consumption of mixed alcoholic drinks. However, that situation changed when the Idaho State Police Bureau of Alcohol Beverage Control (“ABC”) promptly issued additional guidance allowing Idaho bars to sell and provide mixed alcohol drinks via curbside services so long as certain requirements are followed. The delivery of alcohol remains prohibited.
