In the latest Daily of Journal of Commerce Construction Advice column, Stoel Rives construction and design law attorney Karl Oles discusses measures that contractors can take to mitigate the risk of bad weather conditions and other "unforeseen difficulties" in construction contracts. Oles examines the case of Donald B. Murphy Contractors, Inc. v. State of Washington, 40 Wn. App. 98 (1985) as an example of what can happen when contracts do not include a weather-specific contingency clause.
